This website is operated by Commonfolk Coffee Company Pty Ltd (ABN 48 152 399 936) ("Commonfolk", "we", "us"). These terms apply when you use our website at commonfolkcoffee.com.au or buy anything from us online.
By using our site or placing an order, you agree to these terms, along with our Privacy Policy and Refund and Returns Policy.
Our online store runs on Shopify.
To place an order, you must be at least 18, or have permission from a parent or guardian.
You must not use our site to:
We do our best to describe and show our products accurately. Coffee is a natural product, so flavour, colour and roast can vary between batches, and colours on your screen may differ from the real thing.
Product availability, descriptions and features may change at any time. We may discontinue any product without notice.
All prices are in Australian dollars and include GST.
Prices may change at any time. A price change won't affect an order we've already accepted, except where the price was an error (see section 5).
Payment is taken when you place your order.
Your order is an offer to buy. We accept it when we send you an order confirmation email.
We may cancel an order, even after accepting it, if:
If we cancel your order, we'll let you know and give you a full refund.
Delivery times shown on our site are estimates only.
When you place an order, you give authority for our carriers to leave your parcel at your delivery address without a signature. Once tracking confirms it has been delivered to your address, it becomes your responsibility. If you'd rather not have your parcel left unattended, choose pickup from our roastery at checkout.
Please make sure your delivery address is correct. We can't take responsibility for parcels sent to an incorrect address you've provided.
See our Refund and Returns Policy for lost or damaged parcels.
We are not responsible for any delay or failure to meet our obligations caused by events beyond our reasonable control. These include carrier delays or failures, extreme weather, natural disasters, supply shortages, power or internet outages, pandemics and government actions. If this happens, we'll let you know as soon as we reasonably can.
Your subscription will be charged to your nominated payment method on each billing date until you cancel.
You can change, pause or cancel your subscription through your account, or by emailing us. Changes must be made at least 7 days before your next billing date. Changes made within 7 days of billing will apply from the following order.
If we change the price of your subscription, we'll email you at least 7 days before the new price applies. If you cancel during that notice period, you won't be charged the new price.
If a payment fails, we may retry it. If it keeps failing, we may pause or cancel your subscription.
Unless stated otherwise:
Gift cards are valid for 3 years from the date of purchase. They can't be refunded or exchanged for cash, except where required by law. Please treat gift cards like cash. We can't replace lost or stolen gift cards.
Event and class bookings are covered by our Refund and Returns Policy. We may change the content, host or timing of an event. If we cancel or reschedule and you can't attend, we'll give you a full refund.
We may take photos and video at our events. By attending, you agree that we can use images and footage that include you in our marketing, on our website and on social media, without payment. If you'd prefer not to be photographed, let a team member know on the day.
We may refuse entry to, or remove, anyone whose behaviour is unsafe, disruptive or disrespectful, or who is affected by alcohol or drugs. If we do, no refund will be given.
Returns and refunds are covered by our Refund and Returns Policy.
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that can't be excluded.
To the extent permitted by law:
Where our goods or services are not of a kind ordinarily acquired for personal, domestic or household use, our liability for failing to meet a consumer guarantee is limited, at our choice, to replacing or repairing the goods, supplying the services again, or paying the cost of doing so.
We don't guarantee that our site will always be available, uninterrupted or error-free.
You agree to cover any loss, damage or reasonable costs we incur because you misused our site, broke the law, or infringed someone else's rights.
All content on our site, including text, images, logos and design, belongs to Commonfolk or our licensors. You can't copy, reproduce or use it without our written permission.
If you send us feedback, ideas, reviews, photos or other content, you give us a perpetual, worldwide, royalty-free licence to use, copy, edit, publish and share it in any medium, along with your name, without payment. You confirm that your content is yours to share, doesn't infringe anyone's rights, and isn't unlawful, offensive or misleading. We may remove any content at our discretion.
Our site may link to or include tools from third parties. We don't control them and aren't responsible for their content, products or services. Your use of third-party sites and tools is subject to their own terms.
You're responsible for keeping your account details secure and up to date.
We may suspend or close your account, or refuse future orders, at our discretion. If we close an account with an active subscription, we'll refund any amount paid for orders not yet sent.
Our Privacy Policy explains how we collect, use and share your personal information.
We may update these terms at any time by posting the new version on this page. Changes apply from the date they're posted. Please check this page regularly.
These terms are governed by the laws of Victoria, Australia. You and we submit to the courts of Victoria.
We may transfer our rights and obligations under these terms to another entity within the Commonfolk group, or to anyone who acquires our business. You may not transfer your rights or obligations without our written consent.
We may send notices to the email address you gave us with your order or account. A notice sent by email is treated as received when it's sent, unless we receive a delivery failure message.
If any part of these terms is found to be invalid or unenforceable, that part will be removed and the rest will continue to apply.
If we don't enforce any part of these terms straight away, we can still enforce it later.
These terms, together with our Privacy Policy and Refund and Returns Policy, are the entire agreement between you and us for your use of our site and purchases from it.
